Ortigoza
An official of a
number betting game franchisee echoed the adverse pronouncement of the
Philippines Charity Sweepstake Office (PCSO) and the judge of a Regional Trial
Court that Global Mobile Online Corporation (GMOC) otherwise known as Peryahan
ng Bayan (PnB)) lacked the legal authority to operate in Pangasinan.
GMOC Vice
President Lawyer Bernard D. Vitriolo wrote recently Pangasinan Governor Amado
Espino, III and Provincial Police Director Colonel Rederico A. Maranan of the
corporation’s intention to operate again in the mammoth province.
“Iyong pinakita nila na Writ of
Execution ni recall na ng issuing judge,” Speed Game, Incorporated (SGI) official Anthony
Ang-angco said about the illegality of the operation of PnB in Pangasinan when
he submitted to this newspaper copies of PCSO General Manager Royina
Garma
and the Civil Case No. 75149 Order of
Pasig City Regional Trial Court No. 161 Judge Nicanor A. Manalo, Jr.
In February 5, 2020,
Garma wrote to National Bureau of Investigation Director Dante A. Gierran that
the operation of Globaltech Mobile Online Corporation is hereby suspended
effective February 6, 2020 until further instruction from the Office of the
President.
“ This has reference to the Memorandum
from the Executive Secretary of the Office of the President signed by Salvador
C. Medialdea dated January 29, 2020 with regards to our report on the
resumption of the operation of Peryahan games pursuant to the Status Quo Ante Order dated 17
May2020,” excerpt of the
letter of Garma.
Garma told
Gierran that her instruction be disseminated “down the line to your concerned
Regional Directors and Field Offices”.
GMOC Vice President Vitriolo wrote last June 8
Pangasinan Governor Espino and Provincial Police Director Colonel Maranan about
the per approved resolutions and guidelines on the Implementation of Community
Quarantine in the Philippines.
“With the new existing guidelines, GCQ
and MGCQ Areas provides for the relaxation of the rules in the gaming
activities and the like are now allowed to operate as long as compliant to the
Department of Health (DOH) protocols considering the fact that gaming is under
Category IV as reflected on the separate DTI issuance under MC-20-22 S 2020”.
He said the
resumption of the game of chance will ease up the burden of the families of the
more than 30,000 workers of the PnB in the 44 towns and 4 cities province.
“Notwithstanding, if there are matters to be
clarified in relation to our resumption of operation in your area of
jurisdiction in connection with the said Omnibus Guidelines, we are willing to
discuss the matter, cooperate and comply at the convenience of your office,”
Vitriolo wrote Espino and Maranan in the last paragraph of his letter.
Pasig City
Regional Trial Court- Branch 161 Judge Nicanor A. Manalo, Jr. joined General Manager Garma’s opposition to the
operation of GMOC. He wrote that it was not approved by President Rodrigo
Duterte “and is therefore still subject
the suspension order of Garma as pronounced by the president, a copy of the
Memorandum was attached to the said Manifestation”.
“In view of the foregoing and inasmuch
as per order of the court dated December 17, 2019 which stated among others
that the court shall need only suspension order from the Office of the
President, the court take notice of the aforementioned memorandum for the
Office of the President and as such the instant Urgent Manifestation is duly
noted and the Writ of Execution dated January 24, 2020 is recalled,” Order of Judge Manalo to both PCSO and
GMOC dated February 18, 2020.
