Umiinit ang Bangayang Merrera, Rosario sa Binmaley

BINMALEY, Pangasinan – Tila walang katapusan na ang bangayan ng alkalde at bise alkalde dito matapos magkademandahan uli ang mga tagasuporta ng una at ng bise sa Ombudsman sa mga kasong nasa ilalim ng Anti-Graft & Corrupt Practices Act, Environmental Law, at Oral Defamation.

Ani Mayor Pedro Merrera sa writer na ito na nakademanda uli si Vice Mayor Simplicio Rosario sa Ombudsman dahil iyong P11, 700,000.00 na medical bus na merong medical equipment at mobile generator na binili niya noong alkalde pa siya ay segunda mano pero pinapalabas niya na brand new. Ito ay binili ng local na pamahalaan dito noong ika-6 ng Disyembre, 2021 sa Man Automotive Concessionaires Corporation sa EDSA corner Seminary Road, Bahay Toro, Quezon City.

CONTROVERSIAL BUS. The controversial customized P11, 700,000.00 medical bus bought by then Binmaley Mayor Sam Rosario in December 2021 that became controversial because the incumbent mayor Pete Merrera accused the former of deceiving the people of the town that the vehicle was brand new when it was already a used vehicle. Rosario, now Binmaley’s vice mayor, vehemently denied the accusation that became an administrative and criminal cases now in the Ombudsman when the mayor’s supporters sued Rosario and other officials of the coastal town. 

“Kung titingnan mo nga ang pagawa ay iyong ngang makita Volkswagen (engine), iyon mga iyon parte-parte doon”.

Mariing pinabulaanan ni Rosario ang mga akusasyon ni Merrera nang sabihin niya bago ang medical bus na nag-iisa lang ang klase nito sa buong lalawigan ng Pangasinan dahil puedeng gagawin sa loob nito ang mga minor operation gaya ng X-ray, Electrocardiography (ECG), ultrasound, pagkuha ng dugo, at iba pa.

“Sila ang gumawa ng Man ang makina niyan German, chassis brand new lahat iyon. Tapos sinabi na second hand. Sila ang nagsasabi na second hand, customized iyan!”.

Ani sa website ng Man Automative Concessionaire Corporation (MACC), ang MAN at Volkswagen ay magkasamang kumpanya.

”Binayaran na iyon prior noong binalik iyan (sa Man) noong iyang date naman noon na pagkadeliver, kumpleto iyan. Ngayon sumulat kami ngayon sa Man na bakit ganoon ang nangyari? So it’s not the fault of the municipality it was the fault of the owner of the bus company. Dapat ang magbabayad (ng liquidated damages na P842, 400, 00 dahil sa pagkaantalang pag deliver ng 72 araw) ang planta hindi kami,” paliwanag ni Rosario.

Noong ika-11 Oktubre 2023 ay hinabla nina Leon Cruz Castro, Jr, Lorenzo Mayogba Cerezo, at Julian Edgar Gregorio Javier, mga tagasuporta ni Merrera, sa Ombudsman sa Quezon City si Rosario, Municipal Treasurer Teggie D. V. de Guzman, Josephine F. Anchiboy, retired Police Major Diomedes V. Bonalos, Supply Officer Camille G. Lopez, at Bids & Award Committee Vice Chairman Jeffrey R. delos Angeles ng mga administrative at criminal cases.

Inirereklamo nila ang mga kinasuhan ng Serious Dishonesty, Grave Misconduct, and Conduct Prejudicial to the Best Interest of Service (Administrative Cases), Violation of Section 3 (e) of R.A 3019 (Anti Graft and Corrupt Practices Act), Complex Crime of Malversation of Public Funds Through Falsification (Article 217 in relation to Article 171 of the Revised Penal Code as amended), and Rules and Regulations of R.A No. 9184 (Government Procurement Reform Act) (Criminal Cases).  

Ani Commission on Audit (COA) sa kanyang Notice of Disallowance noong May 9, 2024 kontra kay Rosario: “Corollary, on May 21, 2024, the Office of the Mayor of LGU-Binmaley have received a Notice of Disallowance No. 24-001-100-(23) dated May 9, 2024 (Annexes “G ti G-1”) issued by State Audito IV/ Audit Team Leader Atty. Fausto R. Villanueva, Jr. and State Auditor V/ Supervising Auditor Evangeline R. Picar, both from COA-Provincial Satellie Auditing Office (PSAO) xxx The amount of P842, 400.00 was disallowed in audit as liquidated damages due to incurrence of 72 calendar days (CD) delay in the delivery of one unit brand news medical bus with medical equipment and mobile generator set. Inspection Report for Equipement and Facilities dated January 3, 2023 issued by Regional Office No. 1 Technical Audit Group revealed that the project incurred 72 CD of delay, to wit: XXXX”

“Iyong unang allegation nila mababa daw iyong lower part niya. Kaya binaba iyon dahil sa mga senior citizen para sila makapanhik,” ani dating alkalde Rosario na makakalaban ni Merrera sa darating na eleksyon sa Mayo sa pinaka-mataas na posisyong pampubliko dito.

Ani Rosario sana pinalitan na lang ang pintura at binura na lang ni Merrera ang pangalan niya sa bus para magamit ng mga taga Binmaley.

Si Merrera ay may mga nakaabang rin na mga kaso na sinampa sa kanya ni Rosario sa Office of the President at sa Ombudsman.

“Aburido din iyan dahil baka na received na niya iyong kaso rin niya tungkol sa quarrying. Environmental law ang kanyang problem,” ani Rosario kontra kay Merrera sa Ombudsman.

Ang isa pang sinampang kaso ng dating alkalde kay Merrera ay noong murahin siya noong makasalubong ng huli ang tatlong konsehales dito at pagsabihang: “Sabihin niyo sa Vice Mayor niyo na putang In* siya!”

“Siya iyong minura niya ako kasama siya sa mga anim na konsehal at itong quarrying,” saad ni Rosario sa text messages niya sa writer na ito.

Tinanong ng manunulat na ito si Mayor Merrera kung totoo iyong akusayon ni Rosario na minura daw niya ang huli.

Aniya sinungaling daw ang bise alkalde. “Alam mo ang vice mayor na iyan ay sinungaling marunong gumawa ng istorya. Bakit nandiyan iyan bakit andiyan iyong aking mismong Councilor (Banong) delos Angeles iyan lang naman sabihin niya ang totoo”.

Ang mga taga suporta ni Merrera ay naghain noong mga nakaraang taon ng mga kasong administratibo at criminal kay Rosario, Municipal Accountant Teggie V. de Guzman, Municipal Treasurer Josephine F. Anchiboy, at acting Municipal Treasurer Leo V. Fernandez sa Ombudsman dahil sa double payment sa concrete slab ng isang multi-purpose building na ipinatayo ng Department of Public Works & Highway.

Sa Order ni Ombudsman Margie G. Fernandez Calpatura of the Preliminary Investigation, Administrative Adjudication and Prosecution Bureau – C noong February 2, 2024, inuutusan si Rosario at mga kasamang akusado na mag hain ng verified petition position papers sa grave misconduct case na merong Docket No. OMB-L-A SEP 23-0162.
