Judge withdraws writ favoring Peryahan ng Bayan

DAGUPAN CITY – The Pasig City’s Regional Trial Court judge who got the ire of the franchisees of the Small Town Lottery (STL) of the Philippine Charity Sweepstakes Office recalled his Writ of Execution that used to favor the operation of the Globaltech Online Corporation's Peryahan ng Bayan (PnB).

Presiding Judge Nicanor A. Manalo, Jr. withdrew last February18, 2020 the Writ of Execution backing the operation of the PnB.

This upon the instant Urgent Manifestation of the PCSO that cited President Rodrigo R. Duterte did not approve the operation of the PnB and subject to the suspension order last February 6, 2020 of PCSO General Manager Royina Marzan- Garma.

“In view of the foregoing and inasmuch as per Order of the court dated December 17, 2019 which stated among other that the court shall heed any suspension order from the Office of the President, the court takes notice of the aforecited memorandum from the Office of the President and as such the instant Urgent Manifestation is duly noted as the Writ of Execution dated January 24, 2020 is recalled,” Manalo wrote on his Order.

A high official of STL’s Authorized Agent Corporation (AAC), who asked for anonymity, told reporters to drumbeat Judge Manalo’s Order to pressure the Philippine National Police’s provincial director and the chiefs of police to raid and arrest betting stations and personnel of the PnB who still persist to illegally operate.

Earlier, the official denounced Manalo’s Writ of Execution Order favoring PnB that became the reason for the law enforcers to be complacent in running after the employees and officials of the numbers’ betting entity.

Stakeholders of the STL, according to the source, assailed the conflicting stance of the judge and the PCSO that resulted for PnB to operate unhampered in Pangasinan and other parts of the country.

“Those in the PnB were not afraid to operate because they could cite the judge’s writ of execution for them to be in the business,” he said.

He explained to this newspaper that the decision of Manalo to issue the Writ ran smacked to his previous court rulings in October 13, 2017.

The RTC judge on its last order denied for lack of merits Globaltech’s motion to issue a Writ of Injunction on the basis of the alleged refusal of the PCSO to arbitrate and to observe the status quo ante order (SQAO.)

The Court of Appeals decided however on January 14, 2019 that PCSO and Globaltech’s Peryahan ng Bayan to immediately submit themselves to arbitration conformably with the terms of their written agreement and A.M. No. 07-11-08-SC or the Special Rules of Court on Alternative Dispute Resolution.

PCSO said that the defendant has an unremitted obligation to the former by P50, 290, 447.96 as of December 10, 2015 that caused PCSO to terminate Globaltech’s Deed of Authority (DOA).

He added that PCSO will submit itself to arbitration conformably with the terms of their written agreement and A.M No. 07-11-08-SC or the Special Rules of Court on Alternative Dispute Resolution as Court of Appeals’ decision in January 14, 2019.

After the judge issuance of the Writ, PCSO Chair Garma issued an advisory suspending Globaltech PnB to operate its business all over the country.


He said local executive like governors and mayors and the police and operatives of the National Bureau of Investigation are confused because of the Writ of the judge and the suspension of the PnB by Garma.

“Iyong mga local executives para hindi sila maipit dapat walang laro kahit pakitaan sila kopya ng Writ of Execution o suspension. Bakit may laro pa rin? Kasi may payola sila”.

He said the advisory of Garma to suspend PnB should be automatic for the law enforcers to jump against the workers of PnB.

In February 22, Chief PNP Director General Archie Gamboa ordered police regional directors all over the country to wipe out illegal operations of jueteng or be relieved from their posts.

Gamboa said he had already given the police officials a list of jueteng operators in their areas.
