Pugaro Document Can Be On Various Forms - LRA


              AS PROMISED BY LAND DONORS’ LAWYER

DAGUPAN CITY – The document that the lawyer of the donors of the controversial land that will be given to the local government unit (LGU) here can be on various forms, according to an official of the Land Registration Authority.
Lawyer Rufino A. Moreno, the chief of the Register of Deeds here, said that comes January 8, 2020 lawyer Frank Angeles will submit either the Approved Subdivision Survey Plan or The Notarized Request of Partition by the donor spouses Manuel and Ma. Eleanor Pablico and their heirs. The donation created a hullabaloo after one of the six illegal settlers of the 50, 000 square meters land told the administration of this city’s mayor Brian Lim that the real property where the 7,000 Sq. m was donated to the LGU here was mortgaged to a bank in 2016.

“It is not the TCT (Transfer Certificate of Title) because the donors will have to file a subdivision plan of the (50,000 sq.m) land to either the Bureau of Land or the Management Service in San Fernando City in La Union or Land Registration Authority in Quezon City,” Moreno told this writer when the latter asked him if the one to be presented to the public by the lawyer will be a TCT.

Any of the document furnishes by Angeles will show that the donors’ Ma. Eleanor, Archirald, Allan, Arnold, and Artemio Pablico were in good faith when they entered into a transcation with the LGU here, Moreno added.
Moreno told this writer that it was the first time he heard about this brouhaha spawned by the settler at the Sangguniang Panlungsod (City Council) located just in the second floor from the ground floor where the office of the Register of Deeds is located.
"Nobody came here to ask for a copy of the TCT," he said on the encumbrance of the bank to the land of the Pablicos as written at the back  of the TCT.

Recall that after the acceptance of the donation passed by the Sangguniang Panlungsod (City Council), then mayor Belen T. Fernandez signed it into law in 2017 that consummated the contract.
But records of the Register of Deeds here (see photos of the TCT, Encumbrance, and Tax Declaration) showed that the Pablicos mortgaged the 50,000 Sq. m for P8.388 million last July 13, 2016 at the Land Bank of the Philippines  here and the loan reported to the LRA in July 15, 2016.
Moreno said after the approved subdivision survey of the Deed of Partition the donors will submit it to the Office of the Register of Deeds.
Because it is In Rem or a notice to the whole world, anybody can request any of the documents as long as one has a valid written purpose.
These government papers are the Owner’s Duplicate Copy of Title, Deed of Partition, Approved Technical Description and Plan, Tax Declaration, and Tax Clearance.

The tax declaration of the 50, 000 Sq.m has a market value of P2, 000. 000.00 for real properties and Bureau of Internal Revenue’s tax purposes.
Former mayor Fernandez told earlier this newspaper that the current market value of the land in the Island barangay is more than P1,000 per sqm.
Ang lupa sa Pugaro ay nag va-value ng more than P1,000. So five hectares ang kanilang lupa. Makukuwenta mo sa P1,000 that’s about P50 million hindi po pababayaan ng Pablico family na assuming lang na meron silang P8 million or P9million, meron silang credit line hindi po nila pababayaan iyon”.
Pablicos’ lawyer Frank Angeles told recently the SP that as early as 2014, the heirs of the donor spouses informed the Land Bank that a portion of the 50,000 Sq. m had not been mortgaged to the bank.
“As early as 2014 there was already an agreement to the location. Pangalawa, noong pumunta iyong pamilya ng Pablico sa Land Bank sinabi ho nila itong fact na sinabi nila na naka donate na iyong 7,000 sq. m sa siyudad ng Dagupan. Ang demarcation ay sa 40,000 square meters”.
He said however the agreement was not supported by a document.
Angeles informed the members of the city council that the LBP required the heirs to process an official document from the Land Registration Administration and furnish the stakeholders that the donated land is already officially segregated for this city’s LGU.

Declaration of Real Property
Angeles said the LRA promised to release it on January 8, 2020.
“Iyong 7,000 sq. m para sa siyudad was already segregated and submitted sa LRA. So, they are just waiting. Iyong papers nito will come out sa January 8. All of these in good faith ho ni negotiate”.
