Ex-Mayor, Lawyer Assure Public Donated Land Lien-Free

DAGUPAN CITY -  This city former mayor and a lawyer of the land donors assured the public that the 7,000 square meters given to the local government unit (LGU) here is free of future encumbrance from the bank.

Ex –mayor Belen T. Fernandez said despite the credit line of the heirs of Manuel and Maria Eleanor Pablico at the Land Bank of the Philippines (LBP) they will not allow the 7000 Sq. m they donated to the city prejudiced.
The P8 million or P9 milion versus the P50 million at nanininwala ako kasi may usapan naman na sila ang mag sesegrate noong lupa. Hindi naman tayo iyon sila iyan. At naniniwala ako na gagawin nila iyon,” she told reporters recently in a cable television program.

In year 2017, Pablico spouses heirs’ Ma. Eleanor, Archirald, Allan, Arnold, and Artemio, residents of 797 Edsa Diliman, Quezon City, donated the lot at Barangay Pugaro here and was accepted by Fernandez after it was endorsed to her by a resolution passed by the majority members of the Sangguniang Panlungsod (SP) (City Council).

“Whereas, that the said donors, as an act of liberality on their part, by these presents, hereby cede, transfer, and convey by way of donation unto the said donee, Lot Nos. 1-C, 1-E, and 1-F as above described consisting of a total area of 7,000 square meters, together with all the buildings and improvements existing thereon, free and clear of all liens and encumbrances…,” the donors declared on their Deed of Donation.

The former mayor said a landowner in Barangay Pugaro told her the current market value of a one sq. m there was more than P1,000.
Ang lupa sa Pugaro ay nag va-value ng more than P1,000. So five hectares ang kanilang lupa. Makukuenta mo sa P1,000 that’s about P50 million hindi po pababayaan ng Pablico family na assuming lang na meron silang P8 million or P9million, meron silang credit line hindi po nila pababayaan iyon”.

Pablicos’ lawyer Frank Angeles told recently the SP that as early as 2014, the heirs of the donor spouses informed the Land Bank of Philippines that a portion of the 50,000 sq. m had not been mortgaged to the bank.
“As early as 2014 there was already an agreement to the location. Pangalawa, noong pumunta iyong pamilya ng Pablico sa Land Bank sinabi ho nila itong fact na sinabi nila na naka donate na iyong 7,000 sq. m sa siyudad ng Dagupan. Ang demarcation ay sa 40,000 square meters”.

He said however the agreement was not supported by a document.
Angeles informed the members of the city council that the LBP required the heirs to process an official document from the Land Registration Administration and furnish the stakeholders that the donated land is already officially segregated for this city’s LGU.
Angeles said the LRA promised to release it on January 8, 2020.
“Iyong 7,000 sq. m para sa siyudad was already segregated and submitted sa LRA. So, they are just waiting. Iyong papers nito will come out sa January 8. All of these in good faith ho ni negotiate”.

AUTHOR'S TV OPINION ON THE DONATION'S BROUHAHA

After 450 sq. m of this donated real property was given to the six illegal settlers there as agreed on Pre-Demolition Conference held on January 17, 2014 attended by Fernandez and the officials of the Presidential Commission for the Urban Poor, the LGU got 6,550 sq. m.

In early November this year, Councilor Jose Netu Tamayo drafted a resolution requesting the city engineering office through the office of the city mayor, to suspend any introduction of improvement on the lot donated by the Pablicos.
Critics assailed Fernandez for negligence in not knowing that the donated property was encumbered.
A property with lien means the bank can get or demolish the multi-million pesos’ day care center.evacuation center, and other improvements made by the LGU if the land will be subject to foreclosure, as provided on the Civil Code of the Philippines.
This notwithstanding a criminal suit of Anti-Graft & Corrupt Practices Act at the Ombudsman for undue injury to the government and gross inexcusable negligence.

Fernendez disagreed on the accusation.
Nakakahiya baka akala nila ang Dagupan ay puro fake news na lang. Hindi na tayo Child Friendly (national awardee this year), Most Competitive City (Awardee) most fake news city (na)”.

The donation created a hullabaloo recently after one of the six illegal settlers of the land told the administration of this city’s mayor Lim that the real property where the 7,000 Sq. m was donated to the LGU here was mortgaged to a bank in 2016.
The Register of Deeds here furnished this writer data on the P8.338 million encumbrances by the bank to the Pablicos as seen on the Transfer Certificate of Title of their land.
