Babala sa mga Bagong mga Mayor, Konsehales

Babala ito sa mga papasok na mga alkalde (mayors) at mga miyembro (lawmakers) ng Sangguniang Bayan at Panglungsod sa darating na tanghali ng Hunyo 30 ngayong taon.

NEWLY ELECTED. The League of Municipalities of the Philippines (LMP)-Tarlac Chapter took their oath of office before Governor Susan Yap in a ceremony held on September 2, 2022 at the Fortune Seafood Restaurant, Tarlac City.

Tingnan ninyo dito sa blog ko kung paano nakasuhan ng administrative at civil cases ang alkalde at mga miyembro ng Sangguniang Panlungsod (city council) ng Angeles City, Pampanga dahil sa paglabag sa Donation Law.

May nagbigay sa siyudad ng parcel of land para ito ay mapatayuan ng Angeles City Sports Center except cockfighting.

Pero sila Mayor at mga mambabatas nagpatayo ng Drug Rehabilitation Center. Meron silang nilabag ayon sa batas dahil hindi sinunod ng mga donee (sila mayor at mga konsehales) ang kundisyon na gusto ng donor (may ari ng lupa). Ito ang excerpt ng Donation Law sa Civil Code of the Philippines: “The donation shall be revoked at the instance of the donor, when the donee fails to comply with any of the conditions which the former imposed upon the latter.  In this case, the property donated shall be returned to the donor, the alienations made by the donee and the mortgages imposed thereon by him being void, with the limitations established, with regard to third persons, by the Mortgage Law and the Land Registration Laws… (Article 764)”.

Noong umabot ang kaso sa Supreme Court, sinabi ng Kataas-taasang Hukuman na ang pagpagawa at pagiba sa gusali ng Drug Rehabilitation Center ay dapat bayaran ni Mayor at mga Konsehales. “… (P)ublic officials are not immune from damages in their personal capacities arising from acts done in bad faith. They are liable in their personal capacities for whatever damage they may cause by their acts done with malice and in bad faith or beyond the scope of their authority or jurisdiction (citing Vidad vs. RTC Negros Oriental, Branch 42, 45 SCAD 371, G.R. No. 98084, October 18, 1993, M.H. Wylie vs. Rarang, 209 SCRA 357; Orocio vs. COA, 213 SCRA 109).

Bukod sa kasong administratibo (na may kaakibat na suspension o pagkatanggal sa posisyon) pwede silang kasuhan sa Civil Law na merong kasamang danyos o damage sa pagwaldas ng pera ng gobyerno sa ibang proyekto na nagkahalaga ng milyon-milyon piso,
